HADY A PLACE WE CARE ABOUT Many of our residents have lived in the area for over fifty years, others
have moved here over time. One thing
is certain, once at Hady, most spend a lifetime here. The objective of the group is to communicate with both the Chesterfield
Borough Council and the Derbyshire County Council and the Elected Councillors
on behalf of our residents. We work
with and not against our Councils to achieve a satisfactory outcome for our

Click: HERE 25/1/2012 THE DERBYSHIRE COUNTY COUNCIL 20/1/2012 THE DERBYSHIRE COUNTY COUNCIL Our understanding of the law is that caravans can park on land for
twenty-eight days and that time has elapsed for those caravans parked on Hady
Scrubs without planning permission. We
await confirmation from the Chesterfield Borough Council that notice has been
given for them to leave the site. 13/1/2012 MEETING A meeting for local residents is to be held within six weeks. Once a date is finalised residents will be notified. 12/1/2012 HASLAND AND ST LEONARDS COMMUNITY FORUM Many residents attended the Forum and expressed their
opposition to caravans taking residence on land appreciated by residents for
many years on Hady Lane. Reports that the location is being used for commercial vehicles and a
business appears to be operated from the site. Methane was mentioned as a possible risk to families living in the
caravans. We thank the Council for providing information on the legal position
regarding removal of the caravans 10/1/2012 HADY RESIDENTS BECAME CONCERNED Seeing the extent of investment, residents questioned our Councillors
and were given assurances that in accordance with the planning permission
granted, the ruling would apply and caravans would not be allowed on the
land. They expect, without exception that proceedings should be instigated on
19th January 2012 in accordance with the law if the caravans are
not moved from the site. It should be made clear to the land owner that
planning permission for caravans on this land is not a consideration. 6/1/2012 COUNCIL POLICY With regard to the
development of the old farm land, there is a long history of resistance to
this from Chesterfield Borough Council on planning grounds relating to the
open nature of the land and this was supported by our residents. Emails received confirmed just how opposed
our residents are to the land owner allowing the three caravans to move on to
the land after he had convinced the Chesterfield Borough Council Planning
Committee that the intention was to obtain agreement to use the land for
Horses with Storage Sheds. 2/1/2012 PLANNING We believe that the ‘Planning Criteria’ required for a caravan
site on this land could not be met.
Over recent years developers have considered purchasing this land for
building, only to find that a very expensive new sewer would be required for
any additional permanent habitation. If this had not been the case,
development of the frontage could have been considered and possibly
acceptable to our residents. It has
always been made very clear to our Councillors and the Chesterfield Borough
Council that a caravan site would not be acceptable and we have received
assurances that this would not happen. 27/12/2011 ILLEGAL PARKING We understand that the
council is dealing with the matter in accordance with the law. There are however
permitted development rights which allow occupation of the site by up to
three caravans for up to 28 days (Part 5, Class A, Schedule 2 of the Town and
Country Planning (General Permitted Development) Order 1995). It has been confirmed that only three
caravans moved on to the site and therefore the council cannot have them
removed within the twenty eight day period. 27/12/2011 METHANE LEVELS The Chesterfield
Borough Council have been asked to provide the Hady Action Group with the
present methane recordings on the land purchased for paddocks and sheds and
confirm that the area is not subject to any risk for the caravans currently
being used for habitation. It is hoped
that prior to allowing the caravans to move on to the land that the owner
obtained this information as we believe that the CBC cannot be held
responsible for any loss or damage. 21/12/2011 Your councillor has
submitted a request to the enforcement officers at CBC. 21/12/2011 Recently the owner of
land at the rear of the old garage site was granted planning permission for
‘use of field for paddocks & erection of storage timber sheds’. Overnight a number of touring caravans have
moved on to the land and wooden buildings have been erected. This contravenes the planning permission
and your local councillor has been asked to request that the Chesterfield
Borough Council implement proceedings to have the caravans moved off the
site. The Chesterfield
Borough Council planning department believed that the applicant was genuine but
unfortunately this was not the case. |
