HADY A PLACE WE CARE ABOUT YOUR ATTENTION Many of our residents
have lived in the area for over fifty years, others have moved here over
time. One thing is certain, once at
Hady, most spend a lifetime here. The objective of the group
is to communicate with both the Chesterfield Borough Council and the
Derbyshire County Council and the Elected Councillors on behalf of our
residents. We work with and not
against our Councils to achieve a satisfactory outcome for our residents. GROUP ACCOUNTS To
enable our group to operate and send out mail our group needs funds, and
already have received some donations from residents. More funding is required, so if you can
help, no matter how small the amount it will be appreciated. All subscribers will receive a copy of our

are informed that Councillor Blank has taken the receipts for the position to
be reviewed on the basis that the Chesterfield Borough Council or their
Insurers have failed to compensate our residents even though the dangers of
the trees were reported on numerous occasions. Furthermore, this was not the first time
falling branches had caused damage to the fencing and the cost had been born
by the Residents! 26/4/2012 OFFICIAL MOTORHOME PARKING Blackpool
Council has provided a new site for Motorhome Parking. 26/4/2012 CLOUGH FENCE The
fence between the Old Rail Embankment has loose boarding and requires
repairing. 22/4/2012 HADY SHOP Please
let us have your views. Do you think
the Hady Social Club should be demolished?
We will reply to all emails providing your address is supplied. DAMAGED FENCING At
the time of writing we understand that the Chesterfield Borough Council or
their Insurers have not compensated the residents for damaged fences caused
by branches falling off trees on Council Land. NEW FENCING The
owner of land adjacent to Footpath 103 (Hady Lane to Dingle) has placed new
fencing. This has greatly improved the
area. |
SCRUBS PLANNING APPLICATION PLANNING MEETING 14/5/2012 The applicant was refused permission
for a caravan site on the Scrubs. The footpaths walked for many years
by our community are clearly shown. OFFICIAL PLANNING MEETING URGENT The application will be reported to
the Planning Committee Meeting
on 14th May 2012 at 3.00 pm in The Winding Wheel ballroom, Holywell Street,
Chesterfield. Members of the Planning Committee
will be visiting the land at the rear of the garage site at 1. 30 pm on the
same day then move to the Winding Wheel.
It is vital that all Residents assemble
on the Playing Field at 1.15pm before the arrival of the Planning Committee. Hady Residents have always acted in an
orderly manner and it is very important that we keep clear and do not speak
with the Planning Committee and allow them to proceed without obstruction. We can then make our way to The
Winding Wheel for the 3.00 pm Meeting.
Two of our colleagues will speak on our behalf and we can listen to
the outcome, and find if the caravans will be permitted to remain on the
site. 26/4/2012 PLANNING MEETINGS Planning committee meetings as
follows:- All Mondays, all commence at 3 p.m. 14th May 11th June (4 weeks because of the Bank Holiday) 2nd July 23rd
July 11/4/2012 INFORMATION RECEIVED FRON
CHESTERFIELD BOROUGH COUNCIL Recently In so far as the planning
committee date, the application is not to be reported to the 23rd April
meeting. As you refer we sought further information/clarification on 16th
March regarding a number of issues and the applicant’s agent has confirmed
that they are responding but require additional time to be able to respond in
full. I consider a response on the questions asked in the letter of 16th
March 2012 is crucial to the full and proper consideration of the application
by all parties and I am prepared therefore to allow the extra time for the
applicant to respond. This will mean the application will not be heard until,
at the earliest, the following meeting of planning committee on 14th May
2012. 1/4/2012 PLANNING DOCUMENTS CLICK HERE Then CLICK - VIEW DOCUMENTS 18/3/2012 PLANNING APPLICATION PLANNING

homes on the ‘Scrubs’ off Hady Lane. View the Council web site page:
Click: HERE 25/1/2012 THE DERBYSHIRE COUNTY COUNCIL 20/1/2012 THE DERBYSHIRE COUNTY COUNCIL Our understanding of the law is that caravans can park on land for
twenty-eight days and that time has elapsed for those caravans parked on Hady
Scrubs without planning permission. We
await confirmation from the Chesterfield Borough Council that notice has been
given for them to leave the site. 13/1/2012 MEETING A meeting for local residents is to be held within six weeks. Once a date is finalised residents will be notified. 12/1/2012 HASLAND AND ST LEONARDS COMMUNITY FORUM Many residents attended the Forum and expressed their
opposition to caravans taking residence on land appreciated by residents for
many years on Hady Lane. Reports that the location is being used for commercial vehicles and a
business appears to be operated from the site. Methane was mentioned as a possible risk to families living in the
caravans. We thank the Council for providing information on the legal position
regarding removal of the caravans 10/1/2012 HADY RESIDENTS BECAME CONCERNED Seeing the extent of investment, residents questioned our Councillors
and were given assurances that in accordance with the planning permission granted,
the ruling would apply and caravans would not be allowed on the land. They
expect, without exception that proceedings should be instigated on 19th
January 2012 in accordance with the law if the caravans are not moved from
the site. It should be made clear to the land owner that planning permission
for caravans on this land is not a consideration. 6/1/2012 COUNCIL POLICY With regard to the
development of the old farm land, there is a long history of resistance to this
from Chesterfield Borough Council on planning grounds relating to the open
nature of the land and this was supported by our residents. Emails received confirmed just how opposed
our residents are to the land owner allowing the three caravans to move on to
the land after he had convinced the Chesterfield Borough Council Planning
Committee that the intention was to obtain agreement to use the land for
Horses with Storage Sheds. 2/1/2012 PLANNING We believe that the ‘Planning Criteria’ required for a caravan
site on this land could not be met.
Over recent years developers have considered purchasing this land for
building, only to find that a very expensive new sewer would be required for
any additional permanent habitation. If this had not been the case,
development of the frontage could have been considered and possibly
acceptable to our residents. It has
always been made very clear to our Councillors and the Chesterfield Borough
Council that a caravan site would not be acceptable and we have received assurances
that this would not happen. 27/12/2011 ILLEGAL PARKING We understand that the
council is dealing with the matter in accordance with the law. There are
however permitted development rights which allow occupation of the site by up
to three caravans for up to 28 days (Part 5, Class A, Schedule 2 of the Town
and Country Planning (General Permitted Development) Order 1995). It has been confirmed that only three
caravans moved on to the site and therefore the council cannot have them removed
within the twenty eight day period. 27/12/2011 METHANE LEVELS The Chesterfield
Borough Council have been asked to provide the Hady Action Group with the
present methane recordings on the land purchased for paddocks and sheds and
confirm that the area is not subject to any risk for the caravans currently
being used for habitation. It is hoped
that prior to allowing the caravans to move on to the land that the owner
obtained this information as we believe that the CBC cannot be held
responsible for any loss or damage. 21/12/2011 Your councillor has
submitted a request to the enforcement officers at CBC. 21/12/2011 Recently the owner of
land at the rear of the old garage site was granted planning permission for
‘use of field for paddocks & erection of storage timber sheds’. Overnight a number of touring caravans have
moved on to the land and wooden buildings have been erected. This contravenes the planning permission
and your local councillor has been asked to request that the Chesterfield
Borough Council implement proceedings to have the caravans moved off the
site. The Chesterfield
Borough Council planning department believed that the applicant was genuine
but unfortunately this was not the case. |
